Seit Jahren wird in Deutschland mit grosser Intensität darüber diskutiert, ob die sogenannte Rettungsfolter zur Erlangung von Informationen, die das Leben eines Entführungsopfers oder sogar einer Vielzahl von Menschen retten können, strafrechtlich gerechtfertigt werden kann. Jenseits des Atlantischen Ozeans – in der US-amerikanischen Literatur – ist diese Form der Folter schon seit Langem bekannt. Anhand eines Gedankenexperiments, nämlich der »ticking time bomb-Hypothese«, wird heute auch in den USA eine heftige Debatte geführt. Das Ergebnis der Diskussion fällt in den beiden Ländern ganz unterschiedlich aus. Während die Rettungsfolter nach h.M. in der deutschen Rechtsordnung nicht gerechtfertigt werden kann, ist die Frage in den USA derzeit noch nicht abschliessend geklärt. Der Autor zeigt in seinem zusammenfassenden Vergleich, dass zwei wesentliche Unterschiede in der deutschen und der US-amerikanischen Rechtsordnung die rechtliche Bewertung der Rettungsfolter beeinflussen. Der eine Unterschied betrifft die Menschenwürde, der andere das Völkerrecht. Diese Unterschiede kommen vor allem im Verfassungsrecht zum Vorschein, strahlen aber auch auf die gesamte Rechtsordnung der beiden Länder aus.
