Juridicamente, por que entramos na “Vara”? Você sabe o porquê se chama “vara” o lugar onde o juiz trabalha? A vara tem sua origem na fasces da Roma Antiga, de origem Etrusca. Fasces era uma espécie de bastão utilizado para abrir caminho na multidão para dar passagem aos magistrados. Com o tempo passou a ser o que fazia com que a população o reconhecesse e o respeitasse como autoridade. Foi nas Ordenações Manuelinas, que a “vara” passou a se refletir no Direito Português. A vara de juiz ordinário é um símbolo da autoridade desse magistrado eleito pelo povo, que devia trazê-la obrigatoriamente quando andasse pela Vila, em serviço, a pé ou a cavalo, sob pena de quinhentos réis de multa por cada vez que – sem ela – fosse achado. O Juiz Ordinário, ao contrário do juiz de fora (vara branca), tinha origem popular e devia residir no local onde exercia sua função, cabendo-lhe presidir também as sessões da Câmara Municipal, denominada “Senado da Câmara”. O juiz ordinário deveria caminhar carregando uma vara vermelha e o juiz de fora uma vara branca. Promulgadas em 1603, partes das Ordenações Filipinas vigoraram no Brasil até 1916, quando surgiu o Código Civil do mesmo ano. Atualmente, o vocábulo “vara” passou a designar a unidade de jurisdição civil ou criminal, permanecendo na linguagem forense a expressão “debaixo de vara”, que indica a condução coercitiva de alguém à presença do juiz. O termo vara designa a “circunscrição em que o juiz exerce sua jurisdição. Denominação que se dá a cada uma das divisões de jurisdição nas comarcas onde há mais de um juiz de Direito”. No acervo do Museu do Tribunal de Justiça do Estado de São Paulo, você poderá conferir uma peça, com 1,72 metros de altura, é uma das únicas existentes no Estado de São Paulo, e foi doação do desembargador Fernando Euler Bueno, em 1995.
