This 2 page resource details the Tinker V. Des Moines case, which established the precedent that students do not "shed their constitutional rights to freedom of speech or expression at the schoolhouse gate." The U.S. Supreme Court's landmark decision reaffirmed the First Amendment rights of students in public schools, shaping the legal framework for free speech in educational settings. Part One- Details the background of the case ( the wearing of armbands in school, in 1965, as a means to protest the Vietnam War by students John and Mary Beth Tinker and Christopher Eckhardt), the response to the students' actions by the Des Moines Independent School District, the subsequent suspension of the students by the school district, the initiation of a lawsuit against the school district by the students' families, the argument the families used as the basis of their lawsuit, the definition of "symbolic speech", examples of symbolic speech, the ruling of the first court to hear the lawsuit ( The United States District Court for the Southern District of Iowa),the families' appeal to the U.S. Court of Appeals for the Eighth District and that court's decision, assistance to the families rendered by the ACLU, the ACLU's mission, the agreement of the U.S. Supreme Court to hear the case in 1968 and the constitutional issue the court would examine/rule on, the definition of "oral arguments", the court's 1969 ruling, the court's opinion on the school district's actions toward the students in terms of the First Amendment, the majority opinion of Justice Abe Fortas, the definition of " dissenting opinions", the dissenting opinions of Justices Hugo Black and John M. Harlan, the precedents the Tinker V. Des Moines decision established ( protection of free speech in schools, limitations on school authority), and other cases that were impacted by the Tinker V. Des Moines decision ( Bethel School District V. Fraser, Hazelwood School District V. Kuhlmeier, and Morse V. Frederick). Page Two- 26 questions based on part one. This resource is ready for immediate use, no prep. required. A modern print of the First Amendment to the Constitution of the United States, available in variety of sizes and colors, highlighting the five basic civic freedoms — religion, speech, press, assembly, and petition “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” There are few sentences in written history as important as this one. The First Amendment to the Constitution of the United States — the first of the ten that comprise the United States Bill of Rights — is foundational to every freedom Americans enjoy and fight for. While freedom of speech is a defining characteristic of the United States, the First Amendment right is often regulated within certain environments. For years, schools have attempted to monitor and regulate student communication both within the educational environment and in student use of social media and other online communication tools. Censorship and Student Communication in Online and Offline Settings is a comprehensive reference source that addresses the issues surrounding student's right to free speech in on and off-campus settings. Featuring relevant coverage on the implications of digital media as well as constitutional and legal considerations, this publication is an essential resource for school administrators, educators, students, and policymakers interested in uncovering the reasons behind student censorship and the challenges associated with the regulation of students' free speech.
The first amendment to the Constitution of the United States, and a potent reminder of the importance these freedoms are to a true democracy. "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." It was adopted on December 15, 1791, as one of the ten amendments that constitute the Bill of Rights. Presented with a classic style text display and a vintage printing press illustration. The print is available with five different background choices. Featured above is White. Customization is very simple... Just simply look over the colour palette above (second image). You will be able to make your choice in the drop down menu on the order page. The print is available in 5 different sizes: 11x14, 16x20, 18x24, 24x30, and 36x48 inches. Students will use their knowledge of the first ten amendments of the US Constitution, the Bill of Rights, to complete a math-based worksheet. They substitute the ideas on the worksheet with the numbers of the amendments each idea represents and solve simple math problems. For example: freedom of speech + right to bear arms = ____ answer: 1 + 2 = 3 It worked fabulously in my 7th grade US History class. The difficulty of the math can be adjusted for different grade levels. It's cross-curricular and fun! Answer key included.
